EU REACH Compliance

The Registration, Evaluation, Authorization and Restriction of Chemicals Regulation (EC) No 1907/2006, commonly referred to as REACH, is Europe’s chemical legislation which is applicable in all 27 European Union Member States as well as the EFTA European Economic Area (EEA) countries of Norway, Liechtenstein and Iceland. The goal of REACH is to improve the protection of human health and the environment through better and earlier identification of the intrinsic properties of chemical substances.

MTS Systems Corporation (“MTS”) holds a deep respect for the environment and supports the overall objective of improving the health and safety of employees, customers, suppliers, partners and community neighbors. To that end, MTS has established processes and designated appropriate personnel to ensure compliance with the requirements of REACH.

Registration is required under Article 7.1 of REACH if a substance is present in one article and totaling more than 1 ton per producer, per importer, per year and the substance is intended to be released under normal and reasonably foreseeable conditions of use. MTS products are not designed to intentionally release a chemical or substance into the environment; therefore, MTS is not currently required to register.

Notification is required under Article 7.2 of REACH if a product/article contains a “substance of very high concern” (“SVHC”) which is published on the European Chemical Agency’s (ECHA) formal list. On an ongoing basis, MTS will assess all applicable products/articles to determine if any substances in our products are above the 0.1% weight per weight of complete article (“w/w”) threshold and therefore requires notification.

Communication is required under Article 33 of REACH if a supplied product/article contains more than 0.1% (w/w) of any substance(s) on the SVHC candidate list. On an ongoing basis, MTS will assess all applicable products/articles to determine if any substances in our products/articles are above the threshold thereby requiring further communication.
 
Our policy at MTS requires its supply base to comply with all applicable laws and to fully disclose to MTS those substances which may be covered under the REACH directive. Additionally, on a quarterly basis, MTS updates this REACH compliance web page to provide regular updates to our customers about our product content which may fall under the directive.

MTS’ policy is to comply with all applicable legal and regulatory requirements. MTS strives to design and manufacture products that remain environmentally sound throughout their life cycle to reduce our environmental impact for the benefit of current and future generations.
